Golftique - Terms and Conditions

Please read these Terms, as they apply to all Golftique Tours and bookings.

By paying your deposit to us, submitting a ‘Booking Request Form’, or attending one of our Tours, you are agreeing to these Terms.

1) Introduction

In these Terms:

(a) Golftique, our, us or we mean Louise Hogan (ABN 64387928763).

(b) Terms means these terms and conditions.

(c) Tour means a trip organised by Golftique.

2) Bookings

Bookings for Golftique Tours can be made via email to bookings@golftique.com.au.

Our policies are as follows – reflecting both the small group size and the policies of our boutique suppliers:

- Securing a booking

o A 50% deposit is required to secure a booking;

- Final payment of the remaining 50% is due 30 days prior to your Tour commencing;

- For bookings made within 30 days of the Tour, full payment is due at time of booking.

If we have not received the full payment within the time period specified above, we reserve the right to cancel the booking.

3) Minimum Tour size

Golftique has a minimum Tour number to ensure a quality customer experience, and to align with the booking requirements of our accommodation, golf and related suppliers. In the unlikely event – given our small group size - that this minimum number is not reached by the date that is 30 days before the Tour is due to commence, we will offer you a full refund or the option to apply your payment as a credit towards another Tour. The minimum Tour number will vary depending on the Tour you book.

For the purposes of booking your flights, we can confirm when this minimum number has been reached for your Tour. If making bookings in advance of this confirmation from us, please consider making flexible bookings.

4) Prices

Prices are per person and quoted in AUD unless otherwise specified. Prices are valid at time of publishing, but are subject to change at any time prior to your booking being confirmed by us. Please refer to the Tour itinerary for more specifics on all items included in the Tour price. Airfares are not included.

5) Payment

Golftique accepts the following payment methods: direct bank deposits and credit card (Visa or MasterCard). Note credit card payments will incur a 1.8% processing fee.

In the event we must issue a refund via credit card, the refund must go back onto the original credit card charged.

6) Traveling Solo

If you're travelling solo and prefer to share a room then - subject to availability based on the accommodation configuration for the specific Tour - Golftique will endeavour to find you a roommate. The earlier you book, the more likely we can find you a roommate! If no roommate is available when your final payment is due, you will be offered the option to transfer to another Tour (with your deposit applied as a credit), or to upgrade to a single room (for an additional charge).

7) Guest Cancellation Policy

If you wish to cancel your booking, you must notify us in writing. All cancellations by you are subject to the following:

• cancellation before final payment is due: your deposit is forfeited to us;

• cancellation after the final payment is due: 100% of the Tour cost is payable and forfeited to us.

Exceptions to our guest cancellation policy cannot be made for any reason, including but not limited to weather, pandemics, personal, family or medical emergencies.

Additionally, you are not entitled to a refund for arriving late or leaving a Tour early, or for any goods or services you elect not to utilise on Tour.

8) Changes to Tours

Golftique reserves the right to make minor adjustments to a Tour itinerary due to factors such as weather or an unplanned golf course closure or maintenance. All reasonable efforts will be made to substitute with a comparable alternative.

In the unlikely event we are forced to make material changes to the Tour, before the Tour commences, we will notify you as soon as is practicable. If this occurs:

• if you are not happy with the changed Tour details you may transfer to another Tour (with your payments being applied as a credit) if space is available; or

• alternatively, you may cancel your booking and we will refund in full any moneys already paid.

This clause 8 is subject to clause 9 below.

9) Force Majeure

‘Force Majeure’ means the occurrence of an event that is beyond Golftique’s reasonable control, and includes (but is not limited to): (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (b) natural disaster (including but not limited to flooding, fire, earthquake, landslide, volcano disruption, pandemic, epidemic), adverse weather conditions, high or low water levels; (c) nuclear or other industrial accident causing environmental pollution or contamination; (d) change in law, meaning, enactment, amendment (including repeal) in the law or administration of any law in Australia or any jurisdiction or territory relevant to the Tour or these Terms, which includes changes in statute, regulation, determination, by-law, declaration, licence and the common law as applicable from time to time; (e) failure of any third party (such as an accommodation or golf provider) to honour a booking for a Tour.

If Golftique in its reasonable opinion is, as a result of a Force Majeure event, unable to lawfully or safely provide any products or services the subject of your booking with us, Golftique may in its discretion:

• cancel the Tour (in whole or in part);

• change your travel arrangements as reasonably practicable to ensure your safety, and you will be responsible for any additional costs;

• postpone the Tour to new dates.

If we postpone the Tour and the rescheduled dates do not suit you, or if we cancel the Tour (in whole or part), we will offer:

• a credit to the full value you paid for the unperformed part of the Tour, less any costs we cannot recover from third parties, to be used on a future Tour (within 24 months of the original Tour’s departure date);

• a refund in respect of the unperformed part of the Tour - less any costs we cannot recover from third parties.

We will use all reasonable efforts to recover costs from third parties (e.g. accommodation providers) for any unperformed part of the Tour.

10) Flights

We do not arrange the flight element of your Tour. It is your responsibility to make these arrangements and to ensure that your flights coincide with the scheduled transfer times specified by us. We do not accept any liability for any curtailment of your Tour because of any delay arising from your flight arrangements.

11) Transfers

Airport Transfers are included only at the specified times. If you cannot get to the airport in time to meet the transfer to which you have been allocated, or if your flight is delayed by more than one hour and this causes you to miss your allocated transfer, while every effort will be made to provide an alternative transfer solution, we will not be liable for any costs that you incur due to alternative travel arrangements necessary for you to rejoin the trip.

12) Travel Insurance

You must take out comprehensive travel insurance to cover your Tour and associated travel arrangements. We will not be liable for any losses you suffer as a result of failing to take out such insurance.

13) Liability

To the extent permitted by law our liability under these Terms, in respect of a Tour, and for any breach of Statutory Rights, is excluded - but to the extent that such liability cannot be excluded, is limited to one or more of the following, as determined by us: (in the case of goods) the replacement or repair of the goods, supply of equivalent goods or the payment of the cost of replacing or repairing the goods or supplying equivalent goods; and (in the case of services) supply of the services again or the payment of the cost of supplying the services again.

Statutory Rights means all and any terms implied into these Terms or otherwise conferred on you by statute or law including, but not limited to, pursuant to the Competition and Consumer Act 2010 (Cth) (CCA).

Nothing in these Terms has the effect of limiting, or is intended to limit, any rights you may have under the CCA.

14) Special requests

If you have any special requests, please clearly note them on your booking form. We will pass on requests to suppliers or other service providers but we cannot guarantee any requests will be met. Unless we have agreed in writing that your request can be met, we will not be liable for a failure to meet any special request.

15) Conditions of Suppliers

Please note that Tours and our services are provided subject to the conditions of the relevant supplier – for example, accommodation and golf providers. Such conditions can be found on the relevant Supplier websites, or provided via a request in writing to Golftique. You must comply with the conditions of any such providers, and you indemnify us for any loss we may suffer as a result of your failure to comply with those conditions.

16) Complaints and assistance

If you have a complaint about any of the services included in your Tour, you must inform your Golftique host or our office (by email at enquiries@golftique.com.au) as soon as is practicable. We will offer such assistance as we are reasonably able. If the issue is not resolved during your Tour, please follow this up within 14 days of your return home by emailing us with full details of your complaint. If you fail to follow the requirement to report your complaint during your Tour, we may be deprived of the opportunity to investigate and rectify the issue and this may affect your rights.

17) Descriptions and content of website

The information, description, and details of the Golftique Tours on our website are reasonably accurate and correct to the best of our knowledge. We have given all such details, information, descriptions, and details in good faith and any changes are likely to be minor and should not affect the enjoyment of your Tour. However, we make no guarantees that accommodation, golf courses or other goods or services will match the descriptions and images on our website.

18) Physical health

You are taking part in your Golftique Tour at your own risk, and if there is any doubt about your fitness or ability to take part in an activity scheduled or likely to occur on your Tour, you should consult your physician before confirming your booking and taking your place on the Tour.

19) Photographs

By reserving space on a Golftique Tour, we may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our hosts and/or other travellers of you individually or in a group, in any medium, including but not limited to print, electronic media, or internet, free of charge and without your right to inspection, for promoting and publicising our products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the Tour, you must inform us or your host in writing before the commencement of your Tour.

20) Other matters

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be severed from these Terms. The remainder of these Terms shall then be construed as though the unenforceable or invalid provision had never been included, and shall remain in full force and effect.

These Terms are governed by the laws of Victoria, and you and Golftique submit to the non-exclusive jurisdiction of the Courts of Victoria.

If you book a Tour on behalf of other guests, you must provide them with a copy of these Terms prior to paying the deposit on their behalf and you warrant to us that those other guests agree to these Terms.

21) Privacy

Any personal information you provide to us will be stored and used in accordance with our Privacy Policy which is available on our website or upon request.
